1. Accounts
You are responsible for the accuracy of the information you provide and for activity under your account. One account per person. Do not share your login.
2. Acceptable use
Recommendations must be honest and your own. You may not recommend a business you own or control, submit false or defamatory content, scrape the directory, or attempt to manipulate votes, rankings, or recognition.
3. Content license
By submitting a recommendation, photo, quote, or other content, you grant Wallace Consulting LLC dba Top Recommends a non-exclusive, worldwide, royalty-free right to publish, edit for length and clarity, reproduce, and distribute that content in articles, printed editions, and marketing materials, in any medium now known or later developed. You confirm you own the content or have permission to grant this license.
4. Article approval
When an article featuring you or your business is ready, we send a preview for review. You may approve it or request changes. If we do not hear back within seven days of the first notice, the professionally reviewed version publishes automatically so your feature is not missed. Notice is sent to the email and, where consented, the mobile number on the record.
5. Payments and refunds
Memberships and add-ons are billed through Stripe on the terms shown at checkout. Memberships include physical print fulfillment, so payments are not refundable once a print order has been created. Cancellation stops future charges and does not refund the current period unless required by law.
6. Termination
We may suspend or end access for breach of these terms, including recommendation fraud. You may close your account at any time by contacting us.
7. Disclaimers
The service is provided as is and as available, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted or error free.
We are not a party to dealings between you and any business you find here. Recommendations, ratings, and recognition reflect the views of the community members who submitted them, not ours. We do not verify, endorse, or guarantee the quality, safety, licensing, or legality of any business listed, and we are not responsible for the goods or services a business provides to you.
8. Limitation of liability
To the fullest extent permitted by law, Wallace Consulting LLC dba Top Recommends and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the service.
Our total liability for any claim relating to the service will not exceed the greater of one hundred dollars or the amount you paid us in the twelve months before the event giving rise to the claim. Some states do not allow these limits, in which case they apply to the maximum extent the law permits.
9. Indemnity
You agree to indemnify and hold harmless Wallace Consulting LLC dba Top Recommends and its officers, employees, and contractors from any claim, demand, loss, or expense, including reasonable attorney fees, arising out of content you submit, your use of the service, or your breach of these terms.
10. Governing law and venue
These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Sarasota County, Florida, and you consent to the jurisdiction of those courts.
11. Resolving a dispute
If something goes wrong, contact us first at contact@toprecommends.com and we will try to put it right directly. Most problems are settled this way. If we cannot resolve it within thirty days of your first written notice, either of us may take the matter to the courts named in section 10.
12. Changes to these terms
We may update these terms. When we do, we change the version number and effective date shown at the foot of this page. If a change materially affects your rights, we will email members before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms.
